EV Club Terms of Use & Membership

1. Introduction:

These terms govern the use of the EV Club membership services. By subscribing, the member agrees to these terms, updated from time to time by EV Club. Last updated December 31st.

2. Membership Tiers:

Base Membership: $9/month, offers up to $20 of monthly charging rebates.

Premium Membership: $39/month, provides a total charging rebate of $70 monthly.

Unlimited Membership: : $99/month, allows unlimited EV charging. For clarity, the UNLIMITED plan provides unlimited FREE charging. All charging costs will be rebated back to the user.

3. Rebate Mechanism:

Members will receive a rebate for their charging costs, up to their plan’s limit. This rebate will be credited to the user’s digital in-app wallet. After activation, the wallet will be debited for any payments before the user’s debit or credit card is charged.

4. Upgrade/Downgrade Mechanism:

  • Upgrades take effect immediately; prorated charges apply.
  • Downgrades take effect at the end of the current billing cycle, which is the 12-month period from the date of the first sign-up. No refunds for early termination or downgrades.

5. Cancellation Policy:

No immediate refunds for subscription cancellations.

6. Digital Wallet:

Cashback is credited to a digital wallet within the EV Club app. Members can spend in-app for charging, shopping, or planting trees.

7. Feedback and Changes:

Feedback is crucial. Members are encouraged to share their experiences. EV Club retains the right to alter these terms with prior notice to members.

8. Limitations:

EV Club reserves the right to limit the number of rebates a user can claim in a single month based on the type of plan chosen. Limitations are in place to prevent misuse. General personal use is allowed, and misuse, if observed, may be penalized through account suspension, additional fees, or other actions as deemed necessary by EV Club.

9. Third-Party Services:

EV Club may partner with third-party service providers. While we strive for excellence, we are not responsible for delays, service interruptions, or any other issues arising due to third-party services.

10. Liability & Warranty:

EV Club aims to provide continuous service but does not guarantee uninterrupted service. EV Club is not liable for direct or indirect damage due to service interruptions. EV Club does not guarantee the accuracy of the data or information provided.

11. Governing Law & Jurisdiction:

Governed by the laws of California, United States. Disputes subject to the exclusive jurisdiction of the courts of California, United States.

12. Limitation on Claims:

Any claim or action against EV Club must be filed within one year after such claim or cause of action arose.

13. Data Privacy:

User data will be treated with utmost confidentiality. EV Club will not sell or share user data without explicit consent.

14. Commitment Incentives & Annual Review:

Potential discounts or bonus rebates for long-term plans. Members can opt for an annual review to adjust plans based on past usage without penalties.

15. Force Majeure:

EV Club is not liable for any non-performance due to unforeseen circumstances beyond its control, including natural disasters, wars, and other events.

16. Charging Networks & Compatibility:

The EV Club app is designed to be universally compatible with multiple charging networks. However, we cannot guarantee compatibility with every charging station or that every station will be functional at all times. We are not responsible for any damages or inconveniences resulting from using incompatible or malfunctioning charging stations.

17. Charging Limitations for the Unlimited Plan:

The "Unlimited" plan might have a fair-use policy to prevent misuse. For example, any usage beyond 400 kWh/month will be considered beyond the normal threshold and may be subject to additional charges or review.

18. Data Collection and Privacy:

By using the EV Club services, members agree to the collection of their vehicle's charging data. This data is used to improve the app and offer a more personalized experience. We ensure that all data collected adheres to strict privacy regulations and is not sold or shared with third parties without explicit consent.

19. Service Interruptions:

While we strive for continuous operation, the EV Club app or associated services may be unavailable due to maintenance, updates, or unforeseen technical issues. We are not liable for any inconvenience or loss resulting from such interruptions.

20. Pricing Adjustments:

We reserve the right to adjust the membership pricing based on market conditions. Existing members will be notified 30 days in advance of any price changes.

21. Referral Programs and Promotions:

Occasionally, EV Club may offer referral bonuses or promotional deals. These will have their terms, which members agree to abide by when participating.

22. Restrictions on Commercial Use:

Unless explicitly stated, our services are intended for personal, non-commercial use. Commercial users may need a separate agreement or be subject to different terms.

23. Auto-Renewals and Billing:

Memberships are auto-renewed monthly unless canceled by the member. Members are responsible for all charges incurred under their account.

24. Rebate Calculation:

The rebate provided by EV Club is calculated based on the total power received by your electric vehicle during charging sessions and other details like the rate at the time of use, charging location, etc. To ensure fairness, we use the state average energy rate applicable to home charging in your state. This means that regardless of whether you have a home solar setup or not, you receive a rebate that corresponds to the state average rate. It's important to note that energy rates vary across the country, and this approach allows us to provide a consistent and equitable benefit to all members. We are continuously working towards more sophisticated solutions to refine our rebate calculations for an even more personalized experience in the future.
